Terms of Service

These terms govern use of MitigationDraft, operated by S Squared Labs Inc. By creating an account or using the service, you agree to them.

Who may use the service

MitigationDraft is a tool for licensed attorneys and their staff. By using it you represent that you are an attorney, or are acting under the supervision of one, and are authorized to submit the information you provide.

What MitigationDraft is — and is not

MitigationDraft is a drafting assistant. It helps gather a client's biographical information and produces a draft mitigation narrative for the attorney to review. It does not provide legal advice, does not create an attorney–client relationship with us, and is not a substitute for the professional judgment of counsel.

Attorney responsibility

The attorney is solely responsible for reviewing, verifying, editing, and filing any document produced with the service, and for compliance with all applicable rules of professional conduct, court rules, and law. AI output may contain errors and must not be filed without review. Every drafted statement is presented with a reference to its source in the client's intake to support that review.

Client consent and privilege

You are responsible for obtaining any necessary client consent and for using intake links in a manner that preserves privilege. Intake links are intended for out-of-custody clients; for clients in custody, record the interview yourself and upload it rather than using a monitored line.

Payment

Paid features are billed as described at purchase. Fees are non-refundable except where required by law or expressly stated.

Acceptable use

Do not use the service to submit information you are not authorized to submit, to violate any law or court order, or to attempt to disrupt or reverse-engineer the service.

Disclaimers and liability

The service is provided “as is,” without warranties of any kind. To the maximum extent permitted by law, S Squared Labs Inc. is not liable for indirect or consequential damages, and total liability is limited to the amount you paid for the service in the twelve months before the claim.

Changes

We may update these terms; material changes will be posted here with a new effective date.
